MochiiCorp may update these Terms, its website, or applicable brand-specific policies from time to time to identify or describe particular businesses, brands, or Services, but the absence of a brand or venture's name from these Terms does not by itself mean that the brand or venture is excluded from their scope.

Independent Companies and Investments

MochiiCorp may invest in, provide funding to, partner with, collaborate with, advise, support, or otherwise maintain a relationship with companies, organizations, founders, ventures, or other entities that MochiiCorp does not own or control.

An investment, partnership, collaboration, sponsorship, business relationship, or other association does not by itself make an independent company or organization part of MochiiCorp or subject to these Terms.

Independent companies and organizations maintain their own legal identities, operations, terms, policies, and obligations. Their products and services may be governed by separate terms of service, privacy policies, warranties, refund policies, or other agreements.

Intellectual Property

Unless otherwise stated, MochiiCorp and its applicable licensors retain all rights, title, and interest in and to the MochiiCorp name, trademarks, logos, software, designs, graphics, text, interfaces, documentation, and other materials made available through Services owned or operated by MochiiCorp.

Individual MochiiCorp-owned brands may separately own or license their own trademarks, logos, product designs, software, content, and other intellectual property.

Nothing in these Terms grants you ownership of MochiiCorp or any MochiiCorp-owned brand's intellectual property.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or otherwise exploit protected MochiiCorp intellectual property without appropriate authorization, except where permitted by applicable law.

Products and Services

MochiiCorp and its owned or controlled brands may offer a wide variety of products and services across different industries.

Product availability, pricing, specifications, features, functionality, inventory, and access may vary between brands and Services and may change from time to time.

MochiiCorp does not guarantee that any particular product, Service, brand, project, feature, or venture will remain available or continue to operate indefinitely.

MochiiCorp may modify, suspend, discontinue, replace, transfer, sell, or otherwise change a Service, brand, project, product, or business as part of its ordinary business operations, subject to applicable law and applicable contractual obligations.

Marketplace and Purchases

Purchases made through a particular brand or marketplace may be subject to additional terms, refund policies, warranties, shipping policies, product policies, or other agreements specific to that brand.

When placing an order through a MochiiCorp-operated marketplace, you agree to provide accurate and complete billing, payment, and shipping information.

Orders may be subject to product availability, payment verification, fraud prevention measures, inventory limitations, pricing accuracy, and acceptance by the applicable brand or fulfillment provider.

MochiiCorp or the applicable brand reserves the right to refuse, cancel, or limit an order when reasonably necessary, including in cases involving suspected fraud, payment issues, inventory limitations, pricing errors, incorrect product information, or circumstances that prevent an order from being properly fulfilled.

Applicable taxes, shipping charges, and other fees will be presented during checkout or otherwise communicated before purchase where required by law.

Fulfillment, Manufacturing, and Shipping

MochiiCorp-owned brands may use independent third-party companies and service providers to manufacture, source, fulfill, process, package, store, ship, deliver, host, or otherwise support products and services.

These providers operate independently and may have their own terms, policies, procedures, limitations, and contractual relationships.

Shipping and delivery dates are estimates unless expressly stated otherwise. Delays may occur because of carrier issues, weather, holidays, customs, international shipping requirements, supply chain disruptions, production delays, or other circumstances outside of reasonable control.

Customers are responsible for providing accurate and complete shipping information when placing an order. MochiiCorp and the applicable brand are not responsible for orders sent to an incorrect or incomplete address supplied by the customer, except where otherwise required by applicable law.

Any returns, exchanges, refunds, replacements, store credits, warranties, or other purchase remedies will be governed by the applicable brand's policies and applicable law.

Nothing in these Terms is intended to exclude or limit any consumer rights or protections that cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Services provided directly by MochiiCorp or its applicable brands are provided "as is" and "as available" without warranties of any kind, whether express or implied.

MochiiCorp does not guarantee that the Services will always be available, uninterrupted, secure, accurate, complete, or error-free.

Individual brands, products, or Services may provide separate warranties or guarantees where applicable. Those warranties or guarantees will apply according to their respective terms.

Limitation of Liability

To the fullest extent permitted by applicable law, MochiiCorp and its applicable brands will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Services.

This may include, without limitation, loss of data, loss of revenue, loss of profits, loss of business opportunities, business interruption, system failures, or other indirect losses.

Nothing in these Terms excludes or limits liability, warranties, or consumer protections that cannot legally be excluded or limited under applicable law.

Termination and Suspension

MochiiCorp or the applicable brand may suspend or terminate access to a Service where reasonably necessary, including where a user violates these Terms, applicable law, or applicable Service-specific policies.

MochiiCorp may also modify, suspend, discontinue, transfer, sell, or retire a brand, project, product, platform, or Service as part of its business operations, subject to applicable law and contractual obligations.

Changes to These Terms

MochiiCorp may update or modify these Terms from time to time.

Updated Terms become effective when posted unless otherwise stated or otherwise required by applicable law.

Your continued use of Services governed by these Terms after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Governing Law

These Terms shall be governed and interpreted in accordance with the applicable laws governing MochiiCorp and the particular Service involved, without regard to conflict of law principles, except where applicable law requires otherwise.

Where a specific MochiiCorp brand, business, or Service has separate terms specifying governing law or dispute procedures, those terms will apply to the applicable Service to the extent permitted by law.
